Official Rules

 

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. The Muse Health Hands On Movement Sweepstakes (the "Sweepstakes") is sponsored and administrated by CC Wellness, LLC, 29000 Hancock Parkway, Valencia, CA 91355.

 

 

The Sweepstakes consists of four (4) unique contests, one of which begins at 3:00:00 PM Eastern Time (“ET”) on February 1, 2021 and the last of which ends at 11:59:59 PM PT on March 26, 2021 (the “Overall Promotion Period”), as further detailed below. The Sweepstakes contains games of chance.

 

  1. ELIGIBILITY: The Sweepstakes, consisting of four (4) contests (“Contests”), is open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older as of date of entry.  Void where prohibited or restricted by law.  Employees (and their immediate families (parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related) of CC Wellness, LLC (“Administrator”), the Muse Health brand, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies, and their partner businesses (all such parties, collectively, the “Promotion Parties”) are not eligible to enter or win.  By participating, each entrant fully and unconditionally agrees to and accepts to be bound by these Official Rules and the decisions of the Administrator, which are binding and final on matters relating to the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws.

 

  1. CONTEST DETAILS; ENTRY; PRIZES:
  1. Contest I – Tuesday Tag 2 Weekly Drawing: Weeks 1-4
  • 1 winner selected each week during applicable time period.
  • Entrant must: On Instagram, follow @shopmusehealth and tag 2 friends
  • Prize: Each winner and their 2 tagged friends gets 2 bottles of Muse Health hand sanitizer (for total of 6 bottles). Approximate Retail Value:  $20.
  • Promotion Period: Drawing runs from 9:00 AM ET on Tuesdays through 11:59 PM PT on Tuesdays (2/9/2021, 2/16/2021, 2/23/2021, 3/2/2021)

 

  1. II. Contest II – Tuesday Tag 2 Weekly Drawing: Weeks 5-7

 

  • 1 winner selected each week during applicable time period.
  • Entrant must: On Instagram, follow @shopmusehealth and tag 2 friends
  • Prize: Each winner and their 2 tagged friends gets 2 bottles of Muse Health hand sanitizer (for total of 6 bottles), 1 product unit from one of our three product partners. Approximate Retail Value:  $60 - $120.
  • Promotion Period: Drawing runs from 9:00 AM ET on Tuesday through 11:59 PM PT on Tuesday (3/9/2021, 3/16/2021, 3/23/2021)

 

III.  Contest III – Friday Giveaway

 

  • 1 winner selected each week during applicable time period.
  • Entrant must opt into Muse Health mailing list on musehealth.com
  • Prize: Muse hand sanitizer for 1 year (a total of 12 bottles), Muse mask and a care package. Approximate Retail Value:  $230.
  • Promotion Period: Giveaway opens Wednesday at 9:00 AM ET and closes the next day, Thursday, at 11:59 PM PT. (Opens: 2/10/2021, 2/17/2021, 2/24/2021, 3/3/2021, 3/10/2021, 3/17/2021, 3/24/2021)
  • The winner will be announced every Friday (2/12/2021, 2/19/2021, 2/26/2021, 3/5/2021, 3/12/2021, 3/19/2021, 3/26/2021).
  • People who opt in on Wednesdays during the promotion period (9:00 AM ET on 2/10/2021 through 11:59 ET on 3/25/2021) are eligible for the Friday giveaway.

 

  1. IV. Contest IV – Submit Your #HandsonMovement Story

 

  • 7 winners selected total during applicable time period.
  • Entrant must:
    • Fill out form on musehealth.com, submit nomination (up to 200 words)
    • Provide additional 3 additional informational items
    • Follow @shopmusehealth on Instagram
  • Nomination Criteria: Someone who exemplifies the spirit of the #HandsOnMovement, which means individuals who have lifted up others in need, whether through creativity, resourcefulness/ingenuity, or philanthropy/volunteerism.
  • Nominee Prize: Muse hand sanitizer for 1 year (a total of 12 bottles), Muse mask and a care package
  • Winning Story Prize: $3,000 USD, Muse hand sanitizer for 1 year (a total of 12 bottles), Muse mask. Approximate Retail Value, including the $3,000 USD prize: $3,085.
  • Promotion Period: Nomination window is open from 2/1/2021 at 3:00 PM ET through 11:59 PM PT on 3/19/2021.

 

 

  1. ENTRY REQUIREMENTS:  Limit of one (1) Sweepstakes Entry per Contest, per person, per email address or social media account, throughout the Overall Promotion Period. Limit of one (1) Sweepstakes Prize per person/per household. The computer clock of the Administrator is the official time-keeping device in the Sweepstakes.

Entries must comply with the following restrictions:

  • Entry must be suitable for publication (i.e., may not be obscene or indecent) and cannot promote illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous; or any particular political agenda or message; and
  • Entry cannot include the name, likeness, photograph, or other indicia identifying any person, living or dead, without permission from that person.

Any Entrant who incorporates any intellectual property owned by a third party into his or her Entry does so at his or her own risk.

 

  1. CONDUCT: By participating in this Sweepstakes, you agree to be bound by these Official Rules and the decisions of the Sweepstakes Parties, which shall be final, binding and non-appealable in all respects. Failure to comply with these Official Rules may result in disqualification. Administrator reserves the right at its sole discretion to disqualify any individual found to be tampering with the participation process or the operation of the Sweepstakes, or to be acting in any manner deemed by the Administrator to be in violation of the Official Rules, or to be acting in any manner deemed by the Administrator to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person and void all associated Entries and/or registrations.

ANY ATTEMPT BY A USER, YOU OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SWEEPSTAKES PARTIES RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

 

  1. SWEEPSTAKES DRAWING/ODDS: Pursuant to the timelines above, for Contests I, II, and III, the Administrator will conduct random drawings from all eligible Sweepstakes Entries received within the Promotion Period applicable to the specific Contest dates.  For Contest IV, the Administrator will select winners from all eligible Sweepstakes Entries received within the Promotion Period applicable to the Contest IV dates, and the Administrator will select winners in accordance with the above-stated Nomination Criteria, and at the Administrator’s sole and absolute discretion.  Odds of winning for any of the Contests depend on the number of eligible Sweepstakes Entries received during the applicable Promotion Period.

 

  1. WINNER NOTIFICATION: The Administrator will attempt to notify potential winners by direct message or response via social media, email, postal mail, telephone, or by other method, as solely determined by Administrator.  A potential winner will have forty-eight (48) hours to respond to a winning notification before forfeiting the prize.  A potential winner becomes a “Winner” only after verification of eligibility by Administrator, including but not limited to the furnishing of proof of identification and other proof of eligibility under these Official Rules.  If such potential winner cannot be contacted within a reasonable time period, if the potential winner is ineligible, if any notification is returned undeliverable, if the potential winner does not reasonably respond after two separate attempts, or fails to respond with mailing information for the disbursement of the prize, if the prize confirmation or prize is returned as undeliverable, or if the potential winner otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize and an alternate winner will be selected from among all remaining entries for that drawing, at the Administrator’s sole and absolute discretion.  Up to three (3) alternates will be offered each prize, after which the prize will not be awarded.

 

  1. DISTRIBUTION OF PRIZES: All Sweepstakes prizes will be fulfilled approximately five (5) to seven (7) weeks after the Sweepstakes has ended. Prizes will be awarded only upon winner redemption, confirmation, verification and final approval by Administrator. No substitution, assignment, or transfer of any prize or cash alternative permitted, except by Administrator who reserves the right, in its sole discretion, to substitute a prize of equal or greater value, if prize, or portion of prize, becomes unavailable.  The $3,000 USD prize under Contest IV shall be made in the form of a check, or in any other form at the Administrator’s sole discretion.  Sweepstakes Parties are not responsible for late, lost, stolen, damaged, delayed, or undelivered prizes.

 

ANY PRIZE PICTURED OR MENTIONED IN ADVERTISING OR PROMOTIONAL MATERIALS IS FOR ILLUSTRATIVE PURPOSES ONLY AND MAY NOT BE THE ACTUAL PRIZE AWARDED.  PRIZE IS AWARDED “AS IS” WITH NO WARRANTY OR GUARANTEE, EITHER EXPRESS OR IMPLIED BY SWEEPSTAKES PARTIES.  ANY COSTS AND EXPENSES ASSOCIATED WITH PRIZE ACCEPTANCE AND USE NOT SPECIFIED HEREIN AS BEING PROVIDED ARE WINNERS’ SOLE RESPONSIBILITY.

 

  1. PUBLICITY RIGHTS:  By participating in the Sweepstakes or accepting a Prize, each winner grants permission for Sweepstakes Parties and their designees the perpetual right to use his or her name, biographical information, photos and/or likeness, voice, video, city of residence, social media posts related to the Sweepstakes, and story submitted for Contest IV, for promotion, trade, commercial, advertising and publicity purposes, at any time, in any and all media nor or hereafter devised, worldwide in perpetuity, including on Sweepstakes Parties’ and/or unrelated third-parties’ media platforms and sites, without notice, review or approval and without any additional compensation, except where prohibited by law.  All copyright, trademark or other intellectual property rights in such Advertising shall be owned by Administrator and/or its licensors, and each winning participant hereby disclaims and waives any claim of right to such Advertising.

 

  1. GENERAL:  The Sweepstakes Parties do not assume any responsibility for any disruption in the Sweepstakes Parties, including but not limited to the failure or interruption of any internet service provider, computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, traffic congestion, or any other technical difficulty.

In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Sweepstakes materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern, and control. In no event will more prizes be awarded than those listed in Rule #2. All federal, state, and local laws and regulations apply. All decisions as to these Official Rules and interpretations thereof are exclusively within the sole discretion of the Sweepstakes Parties and may be changed from time to time without notice. The Sweepstakes Parties reserve the right to cancel or modify the Sweepstakes at any time without notice. A potential winner may be requested to provide the Administrator with proof that the potential winner is the authorized account holder of the social media account or email address associated with the winning Entry. If, in Administrator’s sole determination, a dispute cannot be resolved, the Entry will be deemed ineligible. Entries generated by a script, macro or other automated means will be disqualified. Entries that are incomplete or corrupted are void and will not be accepted.

  

  1. LIMITATIONS OF LIABILITY: The Sweepstakes Parties assume no responsibility or liability for (a) lost, late, incomplete, stolen, undelivered, inaccurate, delayed, misdirected, damaged or garbled posts, registrations, Entries, URLs, or emails; (b) any incorrect or inaccurate Entry information, or for any faulty or failed electronic data transmissions; (c) any unauthorized access to, or theft, destruction or alteration of Entries or registrations at any point in the operation of this Sweepstakes; (d) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, cable, satellites, servers, computers or providers utilized in any aspect of the operation of the Sweepstakes; (e) inaccessibility or unavailability of the Internet or the Muse Health website or any combination thereof or for computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of Entries, social networking posts, or registrations, the announcement of the prizes, or in any other Sweepstakes-related materials; or (f) any injury or damage to participants or to any other person's computer which may be related to or resulting from any attempt to participate in the Sweepstakes. If, for any reason, the Sweepstakes (or any part thereof) is not capable of running as planned, or the integrity and/or feasibility of the Sweepstakes is significantly undermined by any event beyond the control of the Sweepstakes Parties, for reasons which may include, without limitation, pandemic, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, then the Sweepstakes Parties reserve the right at their sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part. If terminated, the Sweepstakes Parties will award the prizes from among all non-suspect, eligible Entries received for the Sweepstakes up to the time of such action.  If Administrator, in its discretion, elects to alter this Sweepstakes as a result of any of the above reasons, a notice will be posted on the Muse Health website.

 

  1. RELEASES: All participants, as a condition of participation in this Sweepstakes, agree to release, hold harmless and indemnify the Sweepstakes Parties from and against any and all liability, claims, damages, or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained, in whole or in part, directly or indirectly, in connection with (i) participation in any aspect of the Sweepstakes, (ii) the receipt, ownership or use of the prize awarded, including any travel associated with any prize, (iii) participant’s registration material on any related website, or (iv) any typographical or other error in these Official Rules.

 

  1. DISPUTE RESOLUTION: EXCEPT WHERE PROHIBITED, ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION, AND ENFORCEABILITY OF THESE OFFICIAL RULES, OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR WINNERS, ADMINISTRATOR, AND ADMINISTRATOR IN CONNECTION WITH THIS SWEEPSTAKES, SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE UNITED STATES AND THE STATE OF CALIFORNIA. 

AS A CONDITION OF PARTICIPATING IN THE SWEEPSTAKES, EACH ENTRANT AGREES TO ARBITRATE ANY AND ALL DISPUTES, CLAIMS OR CAUSES OF ACTION AGAINST ANY SWEEPSTAKES PARTY.  EACH ENTRANT AGREES TO SUBMIT ANY SUCH DISPUTE FOR RESOLUTION BY ARBITRATION BEFORE THE AMERICAN ARBITRATION ASSOCIATION, WITH THE SITE OF THE ARBITRATION IN LOS ANGELES COUNTY, CALIFORNIA, IN ACCORDANCE WITH THE THEN CURRENT COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION.  FURTHER, EACH ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM INCIDENTAL OR CONSEQUENTIAL DAMAGES, EXEMPLARY DAMAGES, AND PUNITIVE DAMAGES, AS WELL AS ATTORNEYS’ FEES OR OTHER COSTS OF BRINING A CLAIM.

ANY DEMAND FOR ARBITRATION MUST BE FILED WITHIN ONE (1) YEAR OF THE TIME THE CAUSE OF ACTION OCCURRED OR SUCH CAUSE OF ACTION SHALL BE FOREVER BARRED.

 

  1. USE OF DATA: Muse Health and the Administrator will be collecting personal data about entrants online, in accordance with its privacy policy. Please review the Muse Health’s privacy policy at https://musehealth.com/policies/privacy-policy.  By participating in the Sweepstakes, entrants hereby agree to Muse Health and the Administrator’s collection and usage of their personal information and acknowledge that they have read and accepted Muse Health’s privacy policy.

 

  1. TAX INFORMATION: All federal, state, local, and other taxes on prizes and any other costs and expenses associated with prize acceptance and use not specified herein as being provided, are the sole responsibility of the winner.

 

  1. WINNERS LIST: To receive the winner list, send a #10 self-addressed, stamped envelope for receipt by April 15, 2021 to:   Muse Health Hands On Movement Sweepstakes Winners List Request, c/o CC Wellness LLC, CC Wellness, LLC, 29000 Hancock Parkway, Valencia, CA 91355.  Limit one request per person/household address.
